Privacy Policy

 

This privacy policy (the "Policy") describes how we, The Stella McCartney Foundation, use your personal data collected via www.stellamccartneycares.org (the "Website"), for example when you request a Stella McCartney Louise Listening mastectomy bra (the “Product”) or contact us through the Website. In most cases, we are the data controller and responsible for your privacy. Please read this Policy carefully.

Personal Data We May Collect About You

We may collect various types of personal data about you for the purposes described in this Policy, including:

·       contact information (such as your name, nationality, email address, postal address, and telephone number) that you provide through the Website;

·       details of your request for the Product; and

·       personal data that you voluntarily share with us or is contained in communications you send to us, for example if you join a waiting list or have any questions regarding the Website or its contents.

 

The Website is hosted by Squarespace and Squarespace may collect certain information such as IP addresses, your geographical location, device/browser details and information regarding web pages accessed before coming to the Website. This information is collected by Squarespace for its own purposes and Squarespace is the data controller in respect of the personal data it collects. Squarespace has its own privacy policy which applies to this personal data. We recommend that you carefully read the Squarespace privacy policy , cookie policy and terms of service in addition to this Policy.

If you wish to make a donation through the Website, you will automatically be taken to the Paypal site by clicking the Donate button and we recommend that you carefully read Paypal’s privacy policy which applies to the site.

How we use your personal data

You are under no obligation to provide any personal data to us. However, if you request a Product, we do require certain information in order to process your request and send the Product to you.

We use your personal data as explained below:

Contact Information – your name, title, telephone number, address, email address.

We use this information to:

- communicate with you (for example, to respond to any questions you may have);

- where applicable, to send a Product to you;

- verify that you are a consumer and have not previously requested a Product;

- if we do not currently have Product in your size in stock and you choose to join the waiting list, either by emailing us or entering your order details through the Website, we will use the information you submit to inform you when the Product is available;

- to contact you from time to time, for example to follow up on your experience of the Website or Product or to send you news and information but only if you have opted in to receive communications from us.

Transaction Data - your request for the Product and the size requested.

We use this information to:

- process your request for the Product; and

- monitor and managing demand the Product.

Personal Data you choose to share - for example your communications with us.

We use this information to:

- provide customer service support and to respond to communications we receive from you;

- assess and develop the Website;

- train staff; and

- to contact you from time to time, for example to follow up on your experience of the Website or Product or to send you news and information but only if you have opted in to receive communications from us.

Lawful grounds

In order to process your personal data, we are required by law to have a so-called “lawful basis” for such use. There are a number of different lawful bases for processing personal data.

For the processing of your personal data as explained above, the lawful ground we rely on is our legitimate interests as a business and which legitimate interests are not overridden by your fundamental rights and freedoms.

Special categories of personal data

We do not intend to use any special categories of personal data, such as personal data relating to your ethnicity or health.

However, due to the nature of the Product, we appreciate that we may inadvertently receive information from you that could be considered or indirectly relate to data concerning health which is a special category of personal data. We will not use any personal data concerning your health or other special category of personal data unless you have given your express consent to us using such personal data for a particular purpose.

Who else may receive and use your personal data

We may disclose personal data to Stella McCartney Limited and other companies in the Stella McCartney group and to service providers who provide us with support services (for example, IT support) or who are involved in the maintenance of the Website or processing of requests for Products (for example, courier companies).

This may include the transfer of personal data from the relevant individual’s country of residence to third countries. Some of these countries are subject to a data protection adequacy decision of the European Commission, whereas others are not, such as the USA. To ensure the protection of personal data, such transfers outside the individual’s country of residence or the EEA to a third party processing personal data on our behalf will be made pursuant to the EU Model Clauses, the EU-US or CH-US Privacy Shield certification, Binding Corporate Rules or other acceptable legal mechanisms.

We may disclose personal data where required to do so by law, or when we believe that disclosure is necessary to protect our legal rights and/or comply with a judicial proceeding, court order, request from a regulator or any other legal process served on us.

We may anonymise and aggregate information (so that you cannot be identified) and use this aggregated information to assess and develop the Website and our Breast Cancer Awareness campaign. Such aggregated information may be shared with third parties.

Security

We have adopted security measures to protect personal data against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access. For the best possible protection of your personal data outside the limits of the Website or our control, your device should be protected (such as by updated antivirus systems) and your internet service provider should take appropriate measures for the security of network data transmission (such as, for example, firewalls and anti-spam filtering).

While we take reasonable steps to protect your personal data, we cannot guarantee that the personal data you disclose to us will be 100% secure, nor that any data breach will not occur. You accept the inherent security implications of dealing on-line over the Internet and will not hold us or responsible for any data breach unless it is due to our negligence.

How long we keep your personal data

We will retain your personal data only for so long as we have a reasonable business need to keep such information which may include, for example, maintaining our internal business records relating to donations and Product requests. Generally, we will not retain your personal data for more than 1 year after the date of receipt of your request for a Product or your last interaction with the Website.(for example, if you have chosen to join a waiting list for the Product and you then submit a request for the Product when it is back stock, we will continue to retain your personal data for 1 year from the date we process your request for a Product). We may retain your personal data for longer where we consider this necessary for complying with a legal or regulatory obligation or where relevant to an ongoing dispute (either with you or with a third party), to prevent fraud or to enforce our legal rights.

Your rights

You have a number of rights in relation to your personal data including the right:

·       to be informed about how your personal data is used (as we have explained in this Policy);

·       to request access to the personal data we hold about you;

·       to request that we correct any inaccuracies in your personal data;

·       in certain circumstances, to request that we delete your personal data or restrict processing of your personal data;

·       in certain circumstances, to move, copy or transfer personal information you have provided to us; and

·       where we are using your personal data with your consent (for example, where you have agreed to receiving news and information from us), to withdraw your consent.

 

You also have the right to lodge a complaint with a supervisory authority, such as the Information Commissioner’s Office in the UK, if you consider that the processing of your personal data infringes applicable law.
